Daily Backup of Electronic Books in India Becomes Mandatory from 1 April 2026 – Is Your Business Ready?

📢 Important Compliance Alert: Daily Backup of Books of Account Mandatory from 1 April 2026

Businesses maintaining books of account in electronic mode should take note of the compliance requirements under Rule 46(8) of the Income-tax Rules.

The Rule provides that:

“The books of account and other documents maintained in electronic mode shall remain accessible in India at all times, and the back-up of such books of account and other documents maintained in electronic mode shall be kept in servers physically located in India, and shall be updated on a daily basis.”

What does this mean for businesses?

✅ Books maintained electronically must remain accessible within India.

✅ Backup servers must be physically located in India.

✅ Backup data must be updated on a daily basis.

Practical Action Points

🔹 Obtain written confirmation from your software vendor or cloud service provider regarding the location of primary and backup servers.

🔹 Implement an automated daily backup mechanism.

🔹 Maintain backup logs and evidence of successful completion.

🔹 Include Rule 46(8) verification in year-end compliance reviews and tax audit checklists.

Special Attention for TallyPrime Users

If your books are maintained on TallyPrime, ensure that:

✔ Your cloud hosting provider maintains India-based backup servers; or

✔ A separate automated backup process is configured on an India-based server.

For Housing Societies, MSMEs, LLPs & Companies

I recommend implementing a formal Backup & Data Retention Policy and retaining monthly evidence of compliance.

This may soon become a routine verification point during:

• Tax Audits

• Assessments

• Departmental Inquiries

• Litigation Proceedings involving digital books of account

Businesses that act early will be better prepared to demonstrate compliance and avoid unnecessary disputes.
